1. Agreement and Privacy Policy

By creating an account, signing in (including with a third-party identity provider), or using GetSmartResume (“we”, “us”, “the Service”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service.

Use of the Service is also subject to the Privacy Policy, which explains how we collect, use, store, and share personal data—including in connection with authentication, security, analytics and performance tooling, cookies and similar technologies, payment processing through Stripe, and communications. Where the Privacy Policy describes processing based on consent, you may withdraw consent as described there, without affecting the lawfulness of processing carried out before withdrawal (where applicable).

2. Third-party services

The Service may integrate with or depend on third-party services, including without limitation payment processors (such as Stripe), authentication providers, hosting and infrastructure providers, analytics and performance tools, content delivery networks, and email or notification vendors. Those services are subject to their own terms and privacy notices. We are not responsible for third-party services, content, or conduct, except as required by applicable law. Your use of third-party features may require you to accept additional terms directly with the provider.

3. Eligibility and age

You must be at least 16 years old, or the minimum age required in your jurisdiction to enter into contracts and to consent to data processing for this type of service, whichever is higher. If you are not old enough, you must not register or use the Service. Where local law requires parental or guardian consent for minors above that threshold, you represent that such consent has been obtained.

4. Accounts

You must provide accurate, current information and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.

5. Acceptable use and prohibited conduct

In addition to any specific rules posted within the Service, you agree not to:

  • use the Service for any unlawful purpose or in violation of applicable export, sanctions, or anti-fraud laws;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent security or authentication measures;
  • access or use the Service by automated means (including bots, scrapers, or crawlers) to extract, copy, or monitor content or data, except where we offer an official API or grant written permission;
  • reverse engineer, decompile, or disassemble any part of the Service except to the extent mandatory law expressly allows;
  • share, sell, transfer, or sublicense your account credentials, or allow others to use your account;
  • overload, disrupt, or interfere with the integrity or performance of the Service or third-party systems it relies on;
  • misrepresent your identity, affiliation, or authority, or impersonate another person or entity;
  • harass, abuse, harm, or discriminate against others, or upload malware or harmful code.

We may investigate suspected violations and cooperate with law enforcement where permitted.

6. Our rights; your limited license

The Service, including its software, design, branding, articles, guides, tests, company profiles, structured data, and other materials (collectively, “Content”), is owned by us or our licensors and is protected by copyright, trademark, database, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and Content for your personal, non-commercial learning and reference purposes, in accordance with the functionality we make available. Except as expressly permitted by us in writing, you must not copy, reproduce, distribute, publicly display, create derivative works from, sell, rent, lease, or commercially exploit the Content.

7. Copyright and other intellectual property complaints

If you believe that any material on the Service infringes your copyright, trade mark, or other intellectual property rights, please contact us at soniya@getsmartresume.com with enough detail for us to assess the claim, including: your name and contact information; identification of the work or right concerned; the URL or other location of the material; a good-faith statement that the use is not authorized; and a statement that the information you provide is accurate and, where you are not the rights-holder, that you are authorized to act on their behalf. We may remove or restrict access to material where appropriate and will consider counter-notices where applicable law requires.

8. Premium purchases, digital content, and refunds

Paid features or learning tracks may be offered for a one-time fee or as described at checkout. Payments are processed by Stripe; when you pay, you also agree to Stripe’s terms and to providing accurate billing information. Access and entitlements are granted as described on the purchase page and checkout.

EU / UK digital content and immediate performance. Where you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with a statutory right of withdrawal for distance contracts involving digital content: by purchasing digital content that is supplied with immediate access (or immediate performance), you request immediate supply and expressly acknowledge that your right of withdrawal may be lost once access has been made available to you, to the fullest extent permitted by applicable law. Nothing in this section limits non-waivable consumer rights where the law does not allow them to be waived or restricted.

Except where mandatory consumer law requires otherwise, fees are generally non-refundable once the purchased access or content has been delivered or unlocked. If you believe a charge is in error, contact us using the contact details in the Operator section; we will consider good-faith disputes consistent with law and payment-network rules.

9. Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, at our reasonable discretion if we believe you have violated these Terms, misused the Service, created legal, security, or operational risk, or if we are required to do so by law or by a competent authority. We may also discontinue features or the Service generally, subject to applicable law and any express commitments we have made to paying customers.

You may stop using the Service at any time. Provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, governing law, and dispute resolution) will survive termination.

10. Disclaimers

The Service is provided for educational and informational purposes only. We do not guarantee employment outcomes, interview results, examination scores, or the completeness, timeliness, or accuracy of third-party information referenced in our materials. To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. AI-assisted and automated outputs

Some features of the Service may use automated systems, machine learning, or other forms of artificial intelligence to generate or suggest text, scores, summaries, or recommendations (for example in connection with résumés, study aids, or career guidance). Outputs may be incorrect, incomplete, or outdated. You must independently review and validate any AI-assisted output before relying on it for employment, academic, legal, financial, tax, or other important decisions. We do not warrant that AI-assisted outputs are fit for any particular purpose.

12. Limitation of liability

To the maximum extent permitted by applicable law, GetSmartResume, Denis Šachmajev, and their owners, affiliates, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law (including liability for death or personal injury caused by negligence, fraud, or willful misconduct, where applicable).

13. Changes to these Terms

We may update these Terms from time to time. We will post the current version on this page and update the effective date. For material changes, we may also provide additional notice where appropriate—for example by email to the address associated with your account, an in-product banner, or a notice at checkout—depending on the nature of the change and applicable law.

Where permitted by law, your continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service. If mandatory law in your jurisdiction requires a different process (for example, explicit consent for specific changes), we will comply with that requirement.

14. Governing law and dispute resolution

These Terms are governed by the laws of Czech Republic, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.

Subject to any non-waivable rights you may have as a consumer to bring proceedings in your home country, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be brought exclusively in courts of Prague, Czech Republic, and you consent to the personal jurisdiction of those courts. If mandatory consumer law requires a different venue or dispute mechanism for consumers in your country of residence, that law will apply to the extent required.
